Terms of service

These terms govern your use of specb2b.com and any order you place through it. Placing an order means you accept them. We sell to businesses buying branded goods in quantity; the site is not intended for consumer retail purchases.

In these terms "we", "us" and "our" mean SpecB2B, and "you" means the business placing the order.

1. Products, minimums and prices

Every product page states its own minimum order quantity and its full price ladder, so the unit price at each quantity break is published before you ask. The price that applies is the one shown for your quantity at the time you order.

Prices are in US dollars and exclude freight unless a quote states otherwise. Freight is calculated at checkout from the weight of your cart. Setup charges, where they apply, are shown with the price.

We may change prices, withdraw a product, or correct an error at any time before you order. If a price, specification or availability turns out to be wrong after you have ordered, we will tell you before production and you may cancel for a full refund.

2. Quotes

A written quote is valid for 30 days unless it says otherwise. Freight and material costs move, and a quote older than that will be re-priced rather than honoured at a figure that no longer covers the job.

3. Your artwork

You keep ownership of the artwork you send us. You grant us the licence we need to reproduce it on your order, to produce proofs, and to show the finished work as an example of what we make — tell us in writing if you do not want the last of these and we will not.

You warrant that you own the artwork or are licensed to use it, and that printing it does not infringe anyone's trademark, copyright or other right. If you send us a third party's brand, we will ask for written authorisation from the rights holder before we produce it. You indemnify us against any claim arising from artwork you supplied.

We may decline artwork we believe infringes a right, is unlawful, or that we do not want to produce. If we decline before production, you owe nothing.

4. Proofs and approval

Every order gets a free digital proof and nothing is made until you approve it. Approval fixes the artwork, colour and placement, and production time is counted from the day you approve rather than the day you order.

Colour on a physical product will not match a backlit screen exactly, and printed colour varies between materials and decoration methods. If an exact match matters, ask for a physical proof before production. Approving a digital proof is not a warranty of exact colour.

5. Production and delivery dates

Most products take 14 business days in production from the day you approve your proof; some run 10 days and a few 5 to 7, and each product page states its own. Transit is additional: sea freight is 3 to 4 weeks and air about a week.

These are the real times we work to, and we quote them rather than optimistic ones. They are estimates and not guarantees. Freight, customs and events outside our control can move a date. If a date is critical, tell us before you order so we can say honestly whether we can meet it.

6. Payment

Orders are paid by card at checkout, or against an invoice where we have agreed that in writing. Production does not begin until payment has cleared and the proof is approved.

You are responsible for giving us accurate billing and delivery information. Applicable taxes are added at checkout.

7. Shipping

We ship within the United States. Sea freight is duties-paid, so the checkout price is the landed cost. Air freight is priced without import duties, which are payable by you on import; we do not collect or estimate them. Our Shipping Policy sets this out in full.

8. Cancellation

You may cancel at any time before you approve your proof, for a full refund. Once you approve the proof, your goods go into production carrying your logo, they cannot be resold or restocked, and the order cannot be cancelled.

9. Returns

Branded goods carry no change-of-mind return. We put right anything wrong with the goods or the printing, on the terms set out in our Refund Policy, which forms part of these terms.

10. Samples

Samples are supplied unbranded and are representative of the product rather than of your finished order. A sample is not a proof.

11. Warranties and liability

We warrant that your goods will be produced to the proof you approved and will be free from defects in material and workmanship. That is the warranty we give. Beyond it, and to the extent the law allows, the site and the goods are supplied without further warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Where we are at fault, our liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profit, lost business, or the cost of an event going ahead without the goods.

You indemnify us against any claim, loss or cost arising from artwork you supplied, from information you gave us that was wrong, or from your breach of these terms.

Nothing in these terms limits liability that cannot lawfully be limited, and nothing in them excludes liability for fraud.

12. Using the site

Do not use this site to break the law, to infringe anyone's rights, to upload malicious code, to scrape or interfere with its operation, or to submit false information. We may refuse service or close an account for any of these.

We work to keep the information on this site accurate but do not warrant that it is free of errors. Where an error affects your order we will tell you and put it right.

13. Changes to these terms

We may update these terms. The version on this page at the time you order is the version that applies to that order.

14. General

These terms, together with our Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between us about your order, and they replace anything said or written beforehand.

If any part of these terms is found unenforceable, the rest stays in force and the unenforceable part is read as narrowly as it can be while still doing its job.

A right we do not enforce on one occasion is not a right we have given up.

Either of us may end this agreement at any time. Ending it does not affect an order already in production, and the sections on artwork, liability, indemnity and governing law survive it.

15. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules.
